عقد العمل تحت التجربة بين النصوص والواقع والممارسات القضائية

Résumé: أجاز المشرع الجزائري لصاحب العمل إمكانية إخضاع العامل الجديد تشغيله لفترة التجربة لما تحققه مصلحة للطرفين المتعاقدين، كما أحال تحديد مدة فترة التجربة إلى الاتفاقيات الجماعية، فما المراد بفترة التجربة؟ وهل هي واجبة في العقد غير المحدد المدة دون العقد المحدد المدة؟ . قد تنتهي فترة التجربة بآثار سلبية غير مرضية، وعندها إما أن يفسخ العقد المبرم بين الطرفين أو تمدد فترة التجربة للمرة الثانية لإعطاء فرصة أخرى للعامل لإثبات قدراته، أما إذا انتهت فترة التجربة بنتائج إيجابية تثبت مدة العقد المتبقية إذا كانت علاقة العمل محددة المدة، أو يثبت العامل في المنصب الذي رشح له إذا كان العقد غير محدد المدة، و يتم تثبيت العامل بموجب مقرر يشار فيه بوجه خاص إلى المنصب الأصلي الذي عين فيه العامل ورتبته. The Algerian legislator allowed the employer the possibility of subjecting the new worker to his employment for the probationary period for the benefit of the two contracting parties, and also referred the determination of the probationary period to collective agreements, so what is meant by the probationary period? Is it obligatory in an unlimited-term contract without a fixed-term contract? . The probationary period may end with unsatisfactory negative effects, at which point either the contract between the two parties is terminated or the probationary period is extended for the second time to give another opportunity for the worker to prove his abilities. The worker is in the position for which he was nominated if the contract is for an unlimited period, and the worker is confirmed by a decision in which a special reference is made to the original position in which the worker was appointed and his rank.
