الحماية القانونية للطفل من الاستغلال الجنسي عبر الانترنت دراسة وصفية مقارنة بين التشريعات الدولية والتشريع الجزائري

Résumé: الملخص بعد حتمية استخدام تكنولوجيا وسيلة الوسائل "الانترنت" لكل فئات المجتمع، صار الطفل وهو أكثر الفئات حساسية عرضة للعديد من المخاطر التي تسببها، ونجد من بين هذه المخاطر الاستغلال الجنسي الذي يشكل هاجسا تعاني منه جميع الدول في العالم، ونظرا للتزايد الكبير الذي تشهده هذه الظاهرة وهو ما تؤكده الهيئات المختصة وكذا تغطية وسائل الإعلام، فقد تم عقد العديد من الاتفاقيات الدولية والمؤتمرات الرامية إلى توحيد الجهود وحث الدول على وضع قواعد قانونية من شأنها الحد من هذه الظاهرة وحماية الطفل نفسيا وجسديا، وهو ما ستصفه هذه الدراسة وتقارنه بالمنظومة التشريعية التي تحمي الطفل من الاستغلال الجنسي في الجزائر، مبينة مكامن النقص في هذه الأخيرة. Abstract After the inevitability of the use of the Internet technology by all the categories of society, the child which is the most sensitive category has become vulnerable to many of the risks it causes. Among these risks we find the sexual exploitation, which is a concern of all the States in the world. In view of the great increase witnessed by this phenomenon as confirmed by the experts as well as the media coverage, numerous international conventions and conferences have been held to unite efforts and urge States to establish legal rules in order to reduce this phenomenon and to protect the child psychologically and physically. And that will be described in this study and will be compared with the legislative system that protects the child from sexual exploitation in Algeria, indicating the shortfalls in the latter.
