عدم إحقاق الحق بوصفه صورة نمطية سلبية في فلسفة العدالة الانتقالية من منظور التمكين النفسي: الضحية/الجلاد.

Résumé: ملخص: تتناقش هذه الورقة مفهوم العدالة الانتقالية، وذلك فيما يتعلق بعدم إحقاق الحق باعتباره معضلة هيمنت ولا تزال كذلك في العديد من حالات مسارات وإجراءات العدالة الانتقالية الدولية والوطنية. وتنتهي الدراسة بتقديم مفهوم شامل للعدالة الانتقالية من منظور متكامل يتشارك فيه كل الأطراف، مع التركيز أساسا على الفرد الضحية بوصفه محورا أساسيا والتمكين ببعديه النفسي والرمزي المطلوبين إلى جانب التعويض المادي، وذلك ضمن سياقات وتجارب وطنية أيضا عرفتها بعض الدول. هذه الأخيرة التي أصبح يحتذى بها على أنها مقاربات جديدة في تنظير العدالة الانتقالية. Abstract: This paper investigates the transitional justice concept, regarding the denial of justice as a dilemma still dominating, as in several cases of processes and procedures of the international and national transitional justice. To sum up with presenting an overall concept of the transitional justice from an integrated perspective involving all parties, focusing mainly on the individual-victim as key and empowerment with its two required dimensions; psychological and symbolic in addition to the material compensation, with national experiences and settings witnessed by some states. This later becomes an example to follow as a new approach of theorizing transitional justice.
