مصطلح التّخريج عند المالكيّة.

Résumé: ملخّص عربيّ: يهدف هذا البحث للوصول إلى الحقيقة الاصطلاحيّة-الأكثر استعمالاً-لمصطلح: "التّخريج" عند فقهاء المالكيّة حيث تعدّدت الإطلاقات عندهم لهذا المصطلح؛ لكنّ المتتبّع لذلك يجد اختلافاً في المرادات من كلّ إطلاق من استعمال لآخر، فكُتب أصول الفقه غالباً ما تطلقه وتريد به: التّعليل وتوجيه الآراء المنقولة عن العلماء وبيان مآخذهم فيها، وانفرد ابن الحاجب باستعماله استعمالات خاصّة-نُوزع في بعضها- فأورده مرّة مرادفاً لبعض الاصطلاحات مثل: الظّنّ الاستقراء، المذهب؛ ومرّة أخرى أورده مقابلاً لبعض الاصطلاحات، مثل: الاتّفاق، المشهور، الأصحّ، المنصوص المعروف، المذهب؛ بينما أراد به عامّة فقهاء المذهب معنيين هما: تخريج الفروع من الأصول، وتخريج الفروع من الفروع وهذا المعنى الأخير، هو الذي وظّفه أرباب التّخريج مثل: ابن القاسم وابن رشد الجدّ وأضرابهما؛ حيث فشا أمره بينهم فعبّروا عنه بعبارات متنوّعة نحو: "فكذلك هذا عندي" "هو عندي مثل قياس المسائل" "حمل مسألة على مسألة بالقياس" وسلكوا فيه ثلاثة مسالك مسلك التّخريج على روايتين مختلفتين، مسلك التّخريج على مسألة واحدة منصوصة، مسلك التّخريج على خلاف الحكم المنصوص. Abstract : This research aims to reach the most commonly used idiomatic truth of the term: “takhrij” among Maliki jurists, as they have multiple versions of this term. But those who follow this find a difference in the desires from each release from one use to another. The books of Usul al-Fiqh often refer to it as reasoning and directing opinions transmitted from the scholars and stating their deficiencies in it. ,ibn el hadjib; presented it against some conventions such as: the agreement, the well-known, the more correct, the stipulated, the well-known, the madhhab While the general scholars of the doctrine wanted two meanings: takhrij of the branches from the principles, and takhrij of the branches from the branches, and this last meaning is the one employed by the masters of takhrij , such as: Ibn al-Qasim and Ibn Rushd al-Jidd and their offspring. As his matter unfolded among them, they expressed it in a variety of terms towards: “So this is also with me.” “It is like measuring issues for me.” “Conveying an issue to an issue by analogy.” And they followed three paths in it: the course of takhrij based on two different narratives, the course of takhrij on one issue stipulated, the course of takhrij Contrary to the stipulated ruling.
