ملامح التفكير اللغوي الاستعمالي لدى علماء أصول الفقه مقاربة في المخرجات النظرية لفلسفة اللغة

Résumé: ملخص: يتسم علم أصول الفقه بحالة راقية من العمق في البحث والتفكير النظري الذي يرتبط ارتباطا جوهريا مع دواعي استنباط الحكم الشرعي، عبر الآيات الشريفة والأحاديث النبوية، المنتَجة وفقا لأسيقة اللسان العربي المبين ونسقيته، التي كانت مجالا للاشتغال المعرفي الذي باشره علماء أصول الفقه، والأساس الذي قامت عليه بحوثهم، ولذا كان لزاما على أهل هذا الفن، إحداث نوع من التعالق المعرفي بين علوم اللغة المختلفة، وعلم أصول الفقه بدراسة مختلف المسائل اللغوية كالنحو و المنطق و الدلالة و الوضع والاستعمال . ولئن كان الأخذ بالبعد الاستعمالي للغة في الدراسات اللسانية الغربية، التفاتة معرفية تأخر حضورها، بفعل هيمنة التصور النظامي للغة والأنموذج البنوي، فإن التفطن لمسألة الاستعمال ودوره في اقتناص المعنى الباطني، وفاعليته في توجيه الدلالة من خلال السياق المقامي و العرف الثقافي، قد تجسد حضوره بقوة في المدونة العربية التراثية، لا سيما تلك النسخة الأصولية التي أبانت عن وعي عميق ومستوى رفيع من المقاربات التي تقاطعت مقولاتها مع التصور الفلسفي لنظرية الأفعال الكلامية. وهو ما نسعى إلى تجليته من خلال هذه الورقات البحثية. The science of Islamic jurisprudence is characterized by a high level of depth in research and theoretical thinking in various issues related to the inference and interpretation of statements, and which are intrinsically linked to the reasons for the study of Quranic statements and also prophetic through the holy verses and hadiths, produced in contexts of an eloquent and systematic Arabic language, it is a field of cognitive work initiated by scholars of jurisprudence, and the basis on which their researches were founded, the masters of this language science had to expose various linguistic issues such as grammar, logic, semantic, linguistic and also the use of the language. The If we review the modern linguistic sciences, we will notice without much difficulty that the Western thought has been late in addressing the question of usage because of the predominance of the formal perception of language and the structural model. On the other hand, this approach is strongly present in the Arabic corpora and its relationship with the grasp of meaning and its impact on the orientation of meaning through the situational context and socio-cultural convention, and in particular that version of Islamic jurisprudence of language use, which showed a deep awareness and a high level of approaches that intersected with its philosophical conception of the theory of speech acts. This is what we seek to demonstrate through this research work
