النظام القانوني لعقد الترخيص باستعمال العلامة التجارية في التشريع الجزائري واتفاقية تريبس

Résumé: يعد عقد الترخيص بإستعمال العلامة من بين أهم الوسائل والآليات الناجحة لنقل المعرفة الفنية من الدول المتقدمة الي الدول النامية، وهو الأمر الذي من شأنه تحقيق التنمية الاقتصادية للدول التي عملت على سن تشريعات داخلية لحماية أطراف هذا العقد تشجيعا لإبرام مثل هاته العقود لما لها من اهمية في ظل تداعيات الاحكام الجديدة لحماية العلامة التجارية وعقد الترخيص الوارد عليها في اتفاقية تريس، لهذا فالإشكالية المطروحة هل وفق المشرع الجزائري في وضع نظام تشريعي خاص لعقد الترخيص بما يتوافق مع هاته الأحكام الجديدة ؟، لكن بتحليل نصوص الإتفاقية والتشريع الجزائري يتبين أن عقد التّرخیص في الجزائر يخضع للشّروط الموضوعیة العامة الواجب توافرها في كافة العقود ،لهذا يتبغي على المشرع الجزائري سن نظام تشريعي خاص بعقد الترخيص باستعمال العلام التجارية وتحديد الأطر التنظيمية له وتهيئة البيئة التشريعية المناسبة لأطرافه. The licensing contract to use the mark is one of the most successful mechanisms involved in transfer technical knowledge from developed countries to developing countries, Which would achieve the economic development of the countries that have enacted internal legislation to protect the parties to this contract, As well as to encourage them to conclude such contracts in light of the trademark and licensing contract new provisions contained in the TRIPS Agreement. Therefore, What is the compatibility of the legal system for the licensing of the use of a trademark in Algerian legislation with the new provisions of the TRIPS Agreement?. However, the analysis of the agreement and Algerian legislation provisions shows that the license contract in Algeria is subjected to the general substantive conditions of contracts. Therefore, the Algerian legislator should enact a legislative regime for licensing the use of trade marks, defining its regulatory frameworks and creating the appropriate legislative environment for its parties. Le contrat de licence pour l’utilisation de la marque est l’un des moyens et mécanismes les plus importants de transfert de connaissances techniques de pays développés vers des pays en développement, qui permettrait le développement économique des pays qui se sont efforcés d’adopter une législation interne pour protéger les parties au contrat et encourager la conclusion de tels contrats en raison de leur importance Les implications des nouvelles dispositions pour la protection de la marque et du contrat de licence contenues dans l'accord TRIS sont donc problématiques: Quelle est la compatibilité du système juridique en matière de licence d'utilisation de la marque dans la législation algérienne avec les nouvelles dispositions de l'Accord sur les ADPIC ? Le contrat de licence en Algérie est soumis aux conditions générales qui doivent être respectées dans tous les contrats, raison pour laquelle le législateur algérien doit adopter un régime législatif autorisant l’utilisation de la marque, définissant son cadre réglementaire et créant un environnement législatif approprié pour ses parties.
