الإفراج المشروط كآلية مستحدثة لإعادة الإدماج الاجتماعي للمحبوسين في التشريع الجزائري

Résumé: يسعى المشرع الجزائري إلى تطوير السياسة العقابية، وتحسين أساليب المعاملة العقابية للمحكوم عليهم، بإتباع سبيل المدارس العقابية الحديثة، بهدف إصلاح المحكوم عليه وإعادة تأهيله. وتبنى المشرع نظام الافراج المشروط بموجب القانون رقم 05-04، الهدف منه التخفيف من اكتظاظ المؤسسات العقابية، وإدماج المحبوس اجتماعيا، إذا أثبت جدية استقامته وحسن سلوكه، وللإفراج المشروط أنواع، أحدها عادي والأخر لأسباب صحية، وإفراج استثنائي. و هذا الاختصاص من صلاحية قاضي تطبيق العقوبات ووزير العدل، فهو آلية جديدة الغاية منه هو إصلاح المحبوس الموقوف وتمكينه من العودة لأسرته، ليقضي ما تبقى من عقوبة خارج المؤسسة العقابية، وحماية وضمان الحقوق والحريات المحبوس ومصالح المجتمع. The Algerian legislator seeks to develop the punitive policy، and improve the methods of punitive treatment for those sentenced، following the path of modern punitive schools، with the aim of reforming the convict، and rehabilitating him socially. The legislator adopted to Law No. 05-04، the aim of which is to reduce overcrowding in penal institutions، and to integrate socially imprisoned persons، if it proves the seriousness of its integrity and good behavior. As for the competence، the legislator has subjected him to penal enforcement judge and the Minister of Justice، as it is a new mechanism whose purpose is to repair the arrested prisoner from returning to his family، and to protect and guarantee imprisoned rights and freedoms and the interests of society.
