الحماية من العنف الأسري في القانون الجزائري Protection From Domestic Violence In Algerian Law

Résumé: ملخص: يتناول هذا البحث جرائم العنف الأسري، والمتمثلة في جرائم القتل العمد، و الضرب والجرح العمد بين أفراد الأسرة سواء أكان الضحية من الأصول، أو الفروع، أو زوج، وذلك بتبيين أركان كل جريمة والجزاء المترتب عليها. وكذلك تحديد مظاهر الحماية من كل جريمة في القانون الجزائري، ولقد اعتبر قتل الأصول ظرف تشديد، كذلك صفة الأصول في جريمة الضرب والجرح العمد ضد الفروع، وصفة الفروع في جريمة الضرب والجرح العمد ضد الأصول. كما تم تخصيص نصوص قانونية في قانون العقوبات تجرم الضرب والجرح العمد بين الأزواج. الكلمات المفتاحية: العنف، الأسرة، العنف الأسري. Abstract: This research deals with crimes of domestic violence, represented in the crimes of premeditated murder, beating and intentional wounding among family members, whether the victim is an ascendant, descendant, or husband, by clarifying the elements of each crime and the penalty resulting therefrom. As well as defining aspects of protection from every crime in Algerian law, and that killing assets is an aggravating circumstance. Also, the attribute of assets in the crime of beating and intentional wounding against branches, and the description of branches in the crime of beating and intentional wounding against assets was considered an aggravating circumstance. Legal provisions have also been allocated in the Penal Code criminalizing beating and intentional wounding between spouses.
