Résumé: في إطار الدعوة التي أطلقها رئيس الجمهورية للإسراع في رفع التجريم عن أعمال سوء التسيير وتأطيرها عبر نص قانوني فضلا عن دعوة ولاة الجمهورية للانخراط في تشجيع الاستثمار، أصدر رئيس الجمهورية التعليمة الرئاسية رقم 02-2021 المؤرخة في 28 أوت 2021، تتعلق بحماية المسؤولين المحليين، حدد من خلالها الآليات الواجب اتباعها كإجراء أولي تمهيدي لتطبيق رفع التجريم عن أعمال التسيير من أجل إعادة بعث الاقتصاد الوطني وإعادة بعث الثقة للمسيرين، وعليه سنحاول من خلال هذه الورقة العلمية تسليط الضوء على التعليمة الرئاسية وتحليل أبعادها القانونية وآثارها على القطاع العام الاقتصادي مع الوقوف على أهم الإشكاليات القانونية والعملية لتطبيق سياسة رفع التجريم عن أعمال التسيير. In the frame the call made by the President of the Republic to speed up decriminalization lifted on mismanagement and framed by a legal text, as well as an invitation to the governors of the republic to engage in investment promotion, the President of the Republic issued presidential Instruction No. 02-2021 dated August 28, 2021, relating to the protection of local officials, select through mechanisms to be followed as a preliminary measure to implement the decriminalization of management actions in order to revive the national economy and re-establish confidence in the leaders, so we will try through this scientific paper highlight presidential Instruction and analyze its legal dimensions and its effects on the economic public sector with standing on the most important legal and practical problems to implement the policy of decriminalizing the work of management
