المعايير الدولية لمعاملة المرأة المحرومة من حريتها و مدى تطبيقها في الجزائر

Résumé: يؤدي اختلاف ظروف إجرام المرأة عن الرجل من جهة، ودوافع إجرامها من جهة أخرى، إلى اختلاف في متطلبات الدعم اللازمة لبناء حياة جديدة داخل السجن أو بعد إطلاق السراح، كل هذا الاختلاف الجذري يؤدي بالضرورة إلى اختلاف بين وضعية المرأة المحرومة من حرتها ووضعية الرجل السجين، ما يفرض وضع ضوابط تعامل مميزة وإحاطة المرأة بضمانات إضافية لأن مساواتها بالرجل في هذه الحالة قد يشكل في حد ذاته تمييزا ممارسا ضدها، وهذا ما دفع بالأمم المتحدة وغالبية دول العالم إلى السعي لوضع قواعد تساهم في انسنة عقاب المرأة المحرومة من حريتها حتى لا تحرم من إنسانيتها ، من خلال دراسة مظاهر التمييز ضد المرأة في النظم الجنائية القارة ولا سيما في الجزائر ومدى تأثيرها على وضع النساء السجينات، والمعايير الدولية المعتمدة للقضاء على هذه المظاهر، وضمانات معاملة المرأة المحرومة من حرتها في الوضعيات العادية والوضعيات الأكثر هشاشة ومدى تطبيقها في الجزائر. Abstract: The different circumstances of women's crime from men on the one hand, and the motives of her criminality on the other hand, There is a difference in the support requirements needed to build a new life in prison or after release. All of this radical difference necessarily lead to a difference between the status of prisoners women and men, which requires the establishment of distinct treatment and providing women with additional safeguards because their equality with men in this case may in itself constitute discrimination against them, the matter that prompted UN and the majority of the world to seek to establish rules that contribute to the humanization of the punishment of disadvantaged women of freedom so as not to be deprived of her humanity, through examining forms of discrimination against women in criminal systems, particularly in Algeria and their impact on the women prisoners status women, the adopted international standards for the elimination of these forms, the guarantees to treatment of imprisoned women in normal situations and in the most fragile positions and the extent of the application in Algeria.
