المساواة في الإرث بين قواعد الفقه الإسلامي والمواثيق الدولية

Résumé: أثارت قضية ميراث المرأة جدلا واسعا على الساحة الدولية, حيث عرفت تناقضا بين قواعد الفقه الإسلامي, وبين مختلف المواثيق الدولية, فتناولت هذا الموضوع وبينت من خلاله الفرق بين كل من العدل والمساواة, وأن هذه الأخيرة لا تقتضي العدل بالضرورة, منبهة إلى تميز الفقه الإسلامي بتطبيقه لقواعد العدالة في كل الأمور والتي من بينها عدالته في موضوع ميراث المرأة, في مقابل هذه المواثيق التي تدعوا إلى المساواة المطلقة دون مراعاة أو اعتبار للفوارق البيولوجية والإجتماعية بين كلا الجنسين. The issue of women's inheritance has sparked widespread controversy in the international arena, where it has seen a contradiction between the rules of Islamic jurisprudence and various international conventions, which addressed this issue and showed the difference between both justice and equality, and that the latter does not necessarily require justice, alerting to the excellence of Islamic jurisprudence by applying the rules of justice in all matters, including its justice in the subject of women's inheritance, as opposed to these charters calling for absolute equality without regard or consideration of biological and social differences between the sexes.
