متطلبات اعتماد الصكوك الإسلامية في الجزائر على ضوء التجربة الماليزية

Résumé: ملخص: هدفت هذه الدراسة إلى إبراز أهم المتطلبات القانونية، التنظيمية والثقافية الواجب توفرها في الجزائر من أجل اعتماد الصكوك الإسلامية باعتبارها أداة من أدوات التمويل الإسلامي المستحدثة، وذلك من خلال التطرق إلى ماهية الصكوك الإسلامية وأهميتها في تعبئة المدخرات وتوجيهها نحو تمويل الاقتصاد الوطني والقطاعات الاقتصادية، وكذا من خلال التطرق إلى تجربة الماليزية في هذا المجال كونها إحدى الدول الرائدة والمهيمنة على أكثر من نصف إصدارات سوق الصكوك الإسلامية في العالم. وقد خلصت الدراسة إلى أن اعتماد الصكوك الإسلامية في الجزائر يواجه تحديات عديدة على مختلف الأصعدة أهمها الغياب التام للإطار القانوني والتشريعي والتنظيمي الملائم وهو ما يستلزم اصدار قوانين ولوائح تنظيمية تسمح بإصدار وتداول الصكوك الإسلامية وتراعي في ذلك طبيعتها وخصائصها وتضمن حقوق المتعاملين بها. :Abstract This study aimed to highlight the most important legal, organizational and cultural requirements that must be met in Algeria in order to adopt Islamic instruments as one of the new Islamic financing tools, by addressing the nature of Islamic instruments and its importance in mobilizing savings and directing them towards financing the national economy and economic sectors, as well as from While addressing the Malaysian experience in this field, as it is one of the leading countries and dominates in more than half of the issuance of Islamic instruments market in . the world The study concluded that the adoption of Islamic instruments in Algeria faces many challenges at various levels, the most important of which is the complete absence of an appropriate legal, legislative and regulatory framework, which requires the issuance of laws and regulations that allow the issuance and circulation of Islamic instruments, taking into account their nature and characteristics and guaranteeing . the rights of dealers. .
