علاقة الموظف العمومي بالدولة في التشريع الجزائري.

Résumé: إن علاقة الموظف العمومية بالدولة في التشريع الجزائري بصفة عامة، وبالإدارة والسلطة السياسية سواء كانت تشريعية أو تنفيذية بصفة خاصة أصبحت مسألة ضرورية ومهمة للغاية، ذلك أن تحديد تلك العلاقة يحتاج من جهة لترك نوع من المرونة للإدارة في التصرف، ومن جهة أخرى يجب أن ينسجم ذلك ويتناسب مع التحولات السياسية، فما هي إذن طبيعة العلاقة التي تحكم الموظف العمومي بالدولة في التشريع الجزائري؟ إن تلك الرابطة تعد علاقة قانونية أساسية من دون استبعاد العلاقة التعاقدية، كما أن هناك علاقة تبعية ومنافسة وتأثير بين السلطة السياسية والوظيفة العمومية، وبالنتيجة توصلت من خلال هذه الدراسة إلى أن تحسين العلاقة بين الإدارة والموظف العمومي يمر في النهاية بضرورة احترام القانون . The public employee’s relationship with the state in Algerian legislation in general, and with Administration and political authority, whether legislative or executive in particular, has become a very necessary and important issue, because defining this relationship needs on the one hand to leave a kind of flexibility for management to act, and on the other hand it must be consistent with political transformation, so what then is the nature of the relationship that governs the public servant in the state in Algerian legislation? That association is a basic legal relationship without excluding the contractual relationship, as there is a relationship of dependency, competition and influence between the political authority and the public function, and as a result, through this study, I concluded that improving the relationship between the administration and the public official passes in the end the need to respect the law.
