مظاهر تدويل الدساتير الوطنية في مجال الحقوق والحريات الأساسية من خلال هيمنة المصادر الدولية

Résumé: ملخص: تتجاوز ظاهرة تدويل الدساتير الوطنية في مجال الحقوق والحريات الأساسية دراسة العلاقة بين القانونين الداخلي والدولي، وتتجلى من خلال هذا التأثير العام للقانون الدولي بصفة عامة والقانون الدولي لحقوق الإنسان بصفة خاصة على القواعد الدستورية، حيث يطال التدويل قواعد الحماية الموضوعية والحماية الإجرائية للحقوق والحريات الأساسية، في هيمنة واضحة للمصادر الدولية على المصادر الداخلية، ويمتد ليؤثر حتى على السلطات العامة في الدولة، وعلى المؤسسات الدستورية فيها. Abstract: The phenomenon of internationalizing national constitutions in the field of fundamental rights and freedoms exceed beyond the study of the relationship between internal and international law. That’s case is reflected through this general impact of international human rights in general ,and international human rights law in particular on constitutional rules. As internationalization affects the rules of substantive protection and procedural protection of fundamental rights and freedoms. Within a clear domination of international sources over internal sources, this extends to affect even the public authorities in the State, and the constitutional institutions that are linked to them.
