إلزامية التعامل بالفوترة على ضوء قواعد قانون الممارسات التجارية

Résumé: أدى الانفتاح الاقتصادي و تحرير التجارة ، إلى ظهور ممارسات تجارية تمس بالمستهلك بشكل مباشر، تطلب الأمر تدخل القانون لحمايته باعتباره الطرف الضعيف في العلاقة التعاقدية التي تربطه مع العون الاقتصادي ، إذ تدخل قانون رقم 04-02 الذي يحدد القواعد المطبقة على الممارسات التجارية ، بفرض التزامات على العون الاقتصادي ، منها الالتزام بالفوترة موضوع مقالنا ، نعالج من خلاله كالتزام يعكس شفافية الممارسات التجارية تحت طائلة العقوبات في حالة مخالفة أحكام الالتزام بها. Abstract : Economic openness and trade liberalization led to the emergence of commercial practices that directly affect the consumer. It required the intervention of the law to protect him as the weak party in the contractual relationship that binds him with the economic operator, as Law n° 04-02, which defines the rules applicable to trade practices, entered into imposing obligations on economic agent, including the commitment to billing, the subject of our article, we treat it as an obligation that reflects the transparency of commercial practices under penalty of penalties in case of violation of the commitment provisions.
