الدور التشريعي لمجلس الأمة في حماية حقوق الإنسان في ظل الأنظمة البيكاميرالية - The Legislative Role Of The Council Of The Nation In Protecting Human Rights Under The Bicameral Systems

Résumé: بغض النظر عن جل الدواعي السياسية والقانونية التي كانت وراء استحداث غرفة برلمانية ثانية؛ أضحى للغرفة البرلمانية العليا في الأنظمة التي أخذت بالثنائية البرلمانية وهو ما يعرف بالنظام البيكاميرالي، دورا هاما في تحسين التمثيل النيابي وكذا في عملية سن التشريع والرقابة عليها بما يساهم في تعزيز حقوق المواطنين والمحافظة عليها. هذا الدور الذي عزز به المؤسس الدستوري الجزائري مجلس الأمة من خلال التعديل الدستوري لسنة 2016 لا سيما في مادته 136؛ الأمر الذي يضعنا أمام التساؤل عن فعالية الدور التشريعي لمجلس الأمة في حماية حقوق الإنسان والحد من استبداد السلطة، وهو ما لا نجد له فعالية حقيقية في الواقع مقارنة بالأنظمة السباقة في الأخذ بالنظام البيكاميرالي Abstract: Regardless of the political and legal reasons behind the creation of a second parliamentary chamber, The upper parliament chamber became in the systems that have adopted parliamentary dualism which is known as the bicameral system, a very important role In improving representation and also in the process of enacting and controlling legislation enactment In a way that contributes to promoting and protecting the rights of citizens. This role was reinforced by the Algerian constitutional amendment of 2016 for the Council of the Nation, particularly in the article 136. This leads us to the question about the effectiveness of the legislative role of the Algerian Council of the Nation in protecting human rights and reducing the tyranny of the ruling authority, which we don't find real effectiveness in the reality compared to the pre-existing bicameral systems.
