المصالحة كإجراء بديل للدعوى العمومية في جرائم الأعمال_ جريمة الصرف أنموذجا_

Résumé: ملخص: تعد المصالحة الجزائية في جريمة الصرف إحدى أهم بدائل الدعوى العمومية، فهي تهدف بالدرجة الأولى إلى إعطاء فرصة للمتهم من أجل التصالح مع الإدارة مقابل مبلغ مالي يدفع للخزينة العمومية، فضلا على أنها تساهم في الحد من الاستعمال المفرط لسلاح الدعوى العمومية من اجل اقتضاء حق الدولة في العقاب. ولقد نص المشرع الجزائري على هذا النظام بموجب الأمر رقم 96/22 المعدل و المتمم، المتضمن قمع مخالفة التشريع و التنظيم الخاصين بالصرف و حركة رؤوس الأموال من و إلى الخارج، حيث ضبط هذا الأمر ضوابط إجرائها و الأحكام المترتبة عنها بشكل يعكس ذاتية و خصوصية هذا الإجراء مقارنة بغيره من البدائل الإجرائية الأخرى. فالمصالحة كنظام إجرائي تعزز فكرة التحول من العدالة القمعية إلى العدالة التصالحية التي تعد إحدى مرتكزات السياسة العقابية في الوقت الحاضر. Abstract : The criminal reconciliation in the exchange crime is one of the most important alternatives to the public lawsuit. It aims primarily to give an opportunity to the accused in order to reconcile with the administration in return for a sum of money paid to the public treasury, in addition to that it contributes to limiting the excessive use of the weapon of the public lawsuit in order to require the right of the state to punishment. The Algerian legislator provided for this system by virtue of Order No. 96/22, amended and supplemented, which includes the suppression of violating the legislation and regulation related to exchange and the movement of capital to and from abroad, as this order set the controls for its procedure and the provisions resulting from it in a way that reflects the subjectivity and privacy of this The procedure compared to other procedural alternatives. Reconciliation as a procedural system reinforces the idea of shifting from repressive justice to restorative justice, which is one of the pillars of punitive politics at the present time.
