قراءة تحليلية ونقدية لقانون تنظيم السلطة العليا للشفافية والوقاية من الفساد ومكافحته

Résumé: لم يعد الفساد شأنا محليا، بل أصبح ظاهرة دولية بفعل الانتشار الرهيب لتكنولوجيات الإعلام التي جعلت من العالم قرية صغيرة. ويتفق الجميع على انه آفة خطيرة في كافة مناحي الحياة. لهذا تضافرت ملخص : المساعي الدولية والمحلية، و توصلت إلى ضرورة فرض مجموعة من التدابير والآليات لمواجهة الفساد. ومن ضمن هذه الآليات هي إنشاء هيئات تكلف بالوقاية من الفساد، حيث بادر المشرع الجزائري إلى إنشاء الهيئة الوطنية للوقاية من الفساد ومكافحته، لتحل محلها السلطة العليا للشفافية والوقاية من الفساد ومكافحته في التعديل الدستوري لسنة 2020. وعليه تهدف هذه الورقة البحثية إلى قراءة تحليلية و نقدية لمضمون القانون رقم 22 ـ08 المؤرخ في 05 ماي 2022، المحدد لتنظيم السلطة العليا للشفافية والوقاية من الفساد ومكافحته، وتشكيلتها وصلاحياتها، بالتركيز على مدى استقلاليتها و مدى صلاحياتها في مواجهة الفساد. أما أهمية هذا البحث فتتجلى في كونه من موضوعات الساعة وبالخصوص أن قانون تنظيم السلطة العليا حديث الصدور. Abstract: Corruption is no longer a local affair but has become an international phenomenon due to the terrible proliferation of media technologies which have made the world a small village. It is agreed that it is a serious pest in all aspects of life. That is why both international and local efforts raised the need to impose measures and a establish mechanisms to combat corruption. Among these mechanisms are bodies charged with preventing corruption. As regards Algeria's experience, the legislator took the initiative to establish the National Authority for preventing and combating corruption, which was recently replaced by the higher Authority for Transparency, prevention and combating corruption under the 2020 constitutional amendment. Accordingly this research paper is an attempt to make an analysis method and critical reading of the 22-08 Law adopted in May 05, 2022 which specifies the organization of the new Authority, its composition and prerogatives by focusing on the extent of its powers in confronting corruption. As to the importance of this research lies in the fact that it is one of the topical issues which is governed by the new law.
