حماية الحق في حرية المعتقد وممارسة الشعائر الدينية على ضوء القانون الدولي لحقوق الانسان و الواقع الدولي

Résumé: ملخص: هناك اتفاق مبدئي على أن الحق في حرية المعتقد وممارسة الشعائر الدينية هو الحق في حرية الوجدان والضمير في كل ما يتوصل إليه الإنسان من اختيار عن طريق اجتهاده في فهم الدين دون إكراه ولقد تعرض هذا الحق إلى معوقات كثيرة عبر مختلف مراحل التاريخ لكنه أخيرا وجد مكانته ضمن منظومة حقوق الإنسان. وتوجد علاقة قائمة بين الحق في حرية المعتقد وسائر الحقوق والحريات الإنسانية. وقد نصت الشرعة الدولية على هذا الحق، فمثلا الإعلان العالمي لحقوق الإنسان (1948) ، وكذلك معظم الدساتير الحديثة . ولا يزال يعترض هذا الحق معوقات قانونية كعدم إلزامية بعض النصوص القانونية الدولية، وإمكانية تسجيل التحفظات عليها إذا كانت ملزمة وفكرة المحافظة على النظام العام وغيرها من العبارات المائعة والتدخلات السياسية المجحفة Abstract: There is an initial agreement that the right to freedom of belief and the practice of religious rituals is the right to freedom of conscience and conscience in all that a person can choose through his diligence to understand religion without coercion. This right has been exposed to many obstacles throughout the various stages of history, but it has finally found its place within Human rights system. A relationship exists between the right to freedom of belief and other human rights and freedoms. The international bill stipulated this right, for example the Universal Declaration of Human Rights (1948), as well as most modern constitutions. Legal obstacles to this right are still encountered, such as the non-compulsion of some international legal texts, the possibility of registering reservations on them if they are binding, the idea of preserving public order and other fluid phrases and unfair political interference
