Résumé: الملخص باللغة العربية: تهدف هذه الورقة البحثية إلى تقديم قراءة حول دور المرأة ومكانتها في مجتمع المغرب الأوسط ما بين (ق7-9هـ/13-15م)، حيث تسعى إلى الكشف عن وضعيتها في مختلف الحالات التي وردت فيها كفاعلة في الأحداث أو كطرف مفعول به، وذلك بالاعتماد على كتاب المعيار للونشريسي كمادة مصدرية لما له من أهمية في فقه النوازل، ومن ثمّ الوقوف على جهود الفقهاء ومدى سعيهم في معالجة قضية المرأة والجوانب المتعلقة بمكانتها خاصة في علاقاتها الأسرية وما يعتريها من توتر بسبب العادات أو العرف السائد في المجتمع. فبدا لنا واضحا من خلال "المعيار" أنّه رغم تعرض المرأة لبعض المعاملات السيئة سواء مع أهلها كالتمييز بينها وبين الرجل في بعض الأحيان، أو في علاقتها الزوجية أو كالإهانة والضرب، إلاّ أنّها تمتعت في المقابل بوضع حقوقي متميز بمجتمع المغرب الأوسط، كما كان لها حضور قوي في الجانب الاجتماعي والاقتصادي سواء من حيث إسهامها في تنمية المجتمع وتطويره، أو من حيث محاولتها إثبات ذاتها وفرض وجودها وإقرار اختياراتها. Abstract: This research paper aims to provide a reading about the role and position of women in the society of the Middle Maghreb between (7-9 H / 13-15 AD), as it seeks to reveal her position in the various cases in which it is mentioned as an actor in the events, or as an objectionable party, depending on the criterion Al-Wancharisi as a source material because of its importance in the Fikh Annawazil, and then stand on the efforts of the jurists in the society of the Middle Maghreb and the extent of their efforts to address the issue of women and the aspects related to her position, especially in her family relations and the tension she suffers due to customs or norms prevailing in society. It seemed to us through the "standard" that although women were subjected to some bad dealings, whether with their families, such as discrimination between them and men in some cases, or in their marital relationship or as insulting and beating, but in return they enjoyed a distinct human rights status in the Tlemcenian community, and had a strong presence. On the social and economic side, whether in terms of its contribution to the development and development of society, or in terms of its attempt to prove itself, impose its existence and approve its choices.
