Résumé: تحظى حرمة الحياة الخاصة باهتمام بالغ في التشريعات والفقه المقارن الحديث لاتصالها بحريات الأفراد، فهي من أقدس حقوق الإنسان، لكن التشريعات المقارنة تخلت عن إعطـاء تعريف لها رغم أن لها وجـودا لافتا في النصوص الدستورية والقوانين الداخليـة، من خلال التزام الدولة بكفالـة الحريـات الفردية وحرمة المنازل وتجريم اعتراض المراسلات والمحادثات التليفونية وإفشاء الأسرار وغيرها من الحريات الشخصية. وقد تعرض الحق في الحياة الخاصة في الآونة الأخيرة لانتهاكات كثيرة ومتنوعة من طرف الغير، سواء تمثـل هذا الغير في الأفـراد أو الأجهـزة. وكان لتطـور وسائل الإعلام والاتصال الأثر البالغ في تجسيد هذه الخروقات، لذا كان لزاما على التشريعات توسيع دائرة الحماية وتشديدها من خلال نصوص جنائية صارمة. فقد تضمن هذا المقال مفهوم الحق في الحياة الخاصة، وطبيعته القانونية، ومجالاته في التطبيقات القضائية والتشريع المقارن، ثم صور الحماية الجزائية المقررة في التشريع الفرنسي والمصري ثم الجزائري. Abstracts The sanctity of private life has a great interest in the legislation and comparative jurisprudence as they relate to the freedoms of individuals, they are of the most sacred human rights, but comparative legislation abandoned to give a definition, although its presence is remarkable in the constitutional provisions and national laws, through state's obligation to ensure the individual freedoms, the sanctity of homes, criminalization of intercept correspondence, telephone calls, disclosure of secrets, and other personal freedoms. Recently, the right to private life exposed to many and varied violations by others, both represent the third in the individuals or agencies, and the evolution of media and communication had a deep impact of the realization of these violations, so it was imperative for the legislation to expand the scope of protection through strict criminal texts. This article contains the concept of the right to private life, its legal nature, and its fields in judicial applications and comparative legislation. This article included also the types of protections provided by French, Egyptian and Algerian legislation.
