التعويض عن الاضرار الناجمة عن التلوث البحري: قضية سفينة اريكا نموذجا

Résumé: يتميز الضرر البيئي البحري بخصوصية مقارنة بالضرر وفقا للقواعد العامة للقانون المدني، و ذلك من خلال طبيعته و جبره و كيفية تعويض المتضررين منه، و هذه الاخيرة تظهر بكثرة في الاضرار البيئية البحرية التي خلفتها حادثة سفينة اريكا erika و التي نتج عنها العديد من الاشكالات القانونية و المتمثلة في خصوصية نطاق الاضرار التي خلفتها، مسألة الاختصاص، و مسألة تعويض المتضررين منها، فنطاق أضرارها جد واسعة و فصل فيها من قبل القضاء الجزائي عوضا القضاء المدني رغم أن كافة الاشكالات التي تطرحها مدنية و ليست جزائية و في الاخير عالجها المشرع الفرنسي وفقا لمبدأ الضرر البيئي prejudice ecologique المنصوص عليه في المادة 1246 من القانون المدني الفرنسي المستحدث عند تعديل هذا الاخير في سنة 2016، و مضمون هذا المبدأ هو أي شخص مسؤول عن الضرر البيئي ملزم بإصلاحه.
