النظام القانوني لبرامج الحاسب الآلي في التشريع الجزائري The Legal System Of Computer Programs In Algerian Legislation

Résumé: سعت غالبية الدول لحماية برامج الحاسب الآلي، سواء عن طريق القوانين الوطنية، أو عن طريق المعاهدات والاتفاقيات الدولية لبسط وتوفير هذه الحماية، لضمان الابتكار والتأليف وتقدم البشرية نحو الأفضل، فأتت هذه الدراسة لتتطرق بالبحث والتأصيل على الطبيعة القانونية لبرنامج الحاسب الآلي، في قانون براءات الاختراع و قانون حقوق المؤلف والحقوق المجاورة، مستعرضين موقف المشرع الجزائري من المسألة، والحماية المرصودة لها، ثم النتائج والأحكام المترتبة عن كل طبيعة. The majority of countries sought to protect computer programs, whether through national laws, or through international treaties and conventions to simplify and provide this protection, to ensure innovation, authorship and the advancement of humanity for the better. The computer, in the patent law and the law of copyright and related rights, reviewing the position of the Algerian legislator on the issue, the protection allocated to it, and then the results and provisions of each nature.
