Digital Works Protected Under Intellectual Property Rights In International Agreements And Algerian Law
Résumé: عتبر المصنفات الرقمية من بين أكثر حقوق الملكية الفكرية إثارة للجدل القانوني، فهي من بين كل تحديات العصر الرقمي الأكثر إثارة للجدل بالنّظر إلى خصوصية النظام القانوني للملكية الفكرية ببنائها التقليدي، أمّا وقد ارتبطت بتكنولوجيا المعلومات والاتصالات، فلا شك أن إشكالاتها ستكون أكثر تعقيداَ. وتهدف هذه الدراسة إلى استعراض مختلف المصنفات الرقمية المشمولة بالحماية بموجب قوانين الملكية الفكرية، وما هي دواعي تقسيمها إلى مصنفات مرتبطة بالحاسب الآلي وهي؛ برامج الحاسب الآلي وقواعد بيانات وطبوغرافيا الدوائر المتكاملة. وأخرى مرتبطة بشبكة الانترنت وهي؛ الوسائط متعددة وعناوين مواقع الإنترنت وعناوين البريد الإلكتروني. Abstract Digital works are among the most legal controversy of intellectual property rights, One of the most controversial challenges of the digital age given the specificity of intellectual property legal system, with its conventional structure. As being linked to ICT, their forms will undoubtedly be more complex. This study aims at reviewing the various digital works protected under intellectual property laws, as well as the reasons for them to be divided into computer related works are software, databases and integrated circuit topography. Others linked to internet are multimedia, internet addresses and email addresses.
