الضوابط الاقتصادية لحقوق الملكية الفكرية بدواعي المنفعة العامة (براءة الاختراع أنموذجا)

Résumé: مالك براءة الاختراع دون سواء الحق في استغلال اختراعه بالوجه الذي يراه مناسبا لذلك، فالمجهود الذهني الذي بذله المخترع يحتاج للتثمين والاعتراف، لذا نجد ان غالبية الدول وضعت ترسانة قانونية من أجل وضع الاطار الذي ينظم ويحمي براءة الاختراع ومالكها من كل صور المساس والتعدي فهذه الأعمال هي من تثبط عزيمة المخترع وتغير مساره الاختراعي، والمشرع الجزائري لم يشذ عن هذه القاعدة وقام بسن عدة قوانين تعنى بهذا المجال أخرها الأمر 03-07، والذي به قام بوضع إطار قانوني ينظم براءة الاختراع عبر مختلف المراحل وأرسى قواعد حماية وأُسُسَ استغلال تضمن حق مالك البراءة وهذا بما يتوافق مع المنظور الدولي، مراعيا دائما في ذلك فكرة المنفعة العامة لاعتبار أن مصلحة المجتمع أولى، وهذا ما كان يشكل في غالب الأحوال قيد على حق مالك البرءاة في الاستئثار باستغلال براءة اختراعه. The patent owner, without the right to exploit his invention in the face that he deems appropriate, the mental effort done by the inventor needs to be valued and recognized, so we find that the majority of countries have developed a legal arsenal to develop a framework that regulates and protects the patent and its owner from all forms of infringement. The Algerian legislator did not deviate from this rule and enacted a number of laws dealing with this field. The most recent of which was Order 03-07, in which he established a legal framework that regulates the patent through various stages and establishes rules of protection and bases of exploitation guaranteeing the right of the patent owner In line with the international perspective, always taking into account the idea of public utility to consider that the interest of society is first, which often constituted a restriction on the right of the owner of the patent to take advantage of the exploitation of his patent.
