النظام القانوني لجرائم الحرب - دراسة في الجريمة والعقوبة بمقتضى النظام الأساسي للمحكمة الجنائية الدوليّة الدائمة -

Résumé: تهدف هذه الدراسة إلى بيان أهمية الخطوات في مجال القانون الدولي العام، من أجل حماية حقوق الإنسان في أكثر الأوساط انتهاكا لهذه الحقوق؛ أي: أثناء النزاعات المسلحة بنوعيها الدولية وغير الدولية، هذه الخطوات التي تعبّر عن القانون الدولي العام في فرعيه القانون الدولي الإنساني والقانون الدولي الجنائي. وقد توصّلت الدراسة إلى مجموعة من النتائج، من أهمّها أخذ النظام الأساسي للمحكمة الجنائية الدولية بالتقسيم الموضوعي لجرائم الحرب، مما يساعد على الخروج من نفق النصّ القانوني (لا جريمة إلا بنصّ). وكذا اعتبار الجرائم التي ترتكب أثناء نزاع مسلّح غير دولي جرائم حرب تدخل في اختصاص المحكمة الموضوعي. وأيضا اعتبار جريمة الاستيطان ومصادرة الأراضي من ضمن جرائم الحرب، ويُعتبر ذلك أحد مكاسب الدول العربية في مؤتمر روما. وأخيرا عدم إدراج نصّ صريح يقضي بتجريم أسلحة الدمار الشامل ضمن جرائم الحرب. Abstract This study aimed to demonstrate the importance of the steps undertaken in the field of international law for the protection of human rights in more communities in violation of these rights - that is, during armed conflicts both types of international and non-international -, these steps that reflect the evolution of international law in the branches of international humanitarian law and international criminal law.... The study found a set of results are obtained: (1) taking the Statute of the International Criminal Court division of the substantive crimes of war, which helps to get out of the tunnel of the legal text (no offense to the text). (2) considering the crimes committed during an armed conflict not of an international war crimes within the jurisdiction of the Court modes. (3) the crime of settlements and confiscation of land from within the war crimes, and is seen as one gains the Arab States at the Rome Conférence. (4) non-inclusion of an express provision to criminalise weapons of mass destruction as war crimes.
