النظام القانوني الجديد للأوامر العادية The New Legal Order Regular Orders

Résumé: الملخص: تناولت هذه الدراسة الألية الجديدة المتمثلة في سلطة الأوامر التي جاء بها قانون الإجراءات المدنية والإدارية الجديد، كألية خاصة بضمان تنفيذ الأحكام القضائية الصادرة ضد الإدارة، وتم التطرق من خلالها إلى الحالات التي يجوز فيها توجيه هذه الأوامر، والمعايير التي يمكن الإعتماد عليها للتمييز بينهما، وقصد الوقوف على حدود هذه السلطة عالجنا الشروط التي تحكمها، وهذا حتى يتسنى لنا الوقوف على الإخلالات التي قد تحدث عند الحكم بها. وقد تبين لنا من هذه الدراسة الحاجة إلى تدعيم سلطة القاضي في الحكم بتوجيه الأوامر من دون طلب، وكذا منحه سلطة أوامر الإدارة باصدار قرار جديد في المرحلة السابقة و اللاحقة على صدور الحكم. Abstract: This study dealt with the new mechanism represented in the authority of orders mentioned in the new civil and administrative procedures law, as a mechanism for ensuring the implementation of judicial rulings issued against the administration, and through it the cases in which these orders may be directed and the criteria that can be relied upon to distinguish between them. In order to stand on this authority, we dealt with the conditions that govern it to know the imbalances that may occur when judging by it. The study shows the need of granting the judge the authority to direct an order to the administration to issue another new decision in both the previous and precedent stage on non-implementation without limiting it to the next case only. .
