مبدأ عدم الرجعية بين المشروعية الإدارية والأمن القانوني

Résumé: الملخص: يعتبر مبدأ عدم رجعية القرارات الإدارية من أهم المبادئ العامة التي أنشأها القضاء الإداري، وألزم الإدارة باحترامه تحقيقا لمبدأ المشروعية، غير أنه حديثا كان لمجلس الدولة الجزائري وكذلك المؤسس الدستوري موقف جديد تجسد في الاعتراف صراحة بفكرة الأمن القانوني، حيث كان لهذا التوجه تأثير على مبدأ عدم رجعية القوانين بصفة عامة، وأصبح الأمن القانوني الهدف الجديد لهذا المبدأ، فقيام القاضي بإلغاء قرار إداري بسبب انطوائه على أثر رجعي هو بذلك يحقق بطريقة غير مباشرة الأمن القانوني، وبما أن هذا الأخير يعد مبدأ دستوري فإنه يتعين على مجلس الدولة مراعاته في جميع وظائفه. Abstract: One of the most important general principles established by the administrative judiciary is that administrative decisions cannot be applied retroactively, which constitutes one of the requirements of legality. However, recently the Algerian State Council and the constitutional founder had a new position represented in explicit recognition the idea of legal certainty, which affected the principle of non-retroactivity of laws in general. The legal certainty has become the new aim of this principle. Judicial cancellation of a retroactive administrative decision is thus indirectly achieving legal security, and since non-reactionary is a constitutional principle, the State Council must respect it in all its functions.
