Résumé: تزايد انتشار الفساد في الدول المغاربية بشكل كبير، رغم سلسلة الآليات القانونية والمؤسساتية المعتمدة لمكافحة هذه الظاهرة الخطيرة، ويرجع ذلك إلى عدة أسباب وعوامل قمنا بتوضيحها في هاته الدراسة، منها السياسية والاقتصادية والمالية وحتى القانونية أيضا، وتبعا لذلك تنوعت مظاهر الفساد وصوره، حيث تطرقنا إليها حسب مجال الفساد من جهة مثل الفساد السياسي والفساد المالي و الإداري،... و حسب الجرائم التي تمثله من جهة أخرى سواء جرائم الفساد التقليدية التي نصت عليها قوانين العقوبات للدول المغاربية، إلى جانب جرائم الفساد المستحدثة في إطار القوانين الخاصة بمكافحة الفساد، والتي جاءت تماشيا مع أحكام اتفاقية الأمم المتحدة لمكافحة الفساد. كل هاته الصور والمظاهر للفساد أدت إلى آثار سلبية وخيمة على اقتصاديات الدول المغاربية، وعلى أنظمتها السياسية والمالية والاجتماعية، على غرار الجزائر وتونس والمغرب، التي جعلناها نموذجا لهاته الدراسة، محاولين إبراز أهم مسببات الفساد فيها ومظاهره التي ينبغي القضاء عليها أو التخفيف منها على الأقل، عوض تركيز الجهود على مكافحة الفساد بعد وقوعه، كل هذا من أجل تفادي الأضرار الكبيرة التي يسببها لهاته الدول المغاربية. The spread of corruption in the Maghreb countries has increased considerably, despite a series of legal and institutional mechanisms adopted to combat this dangerous phenomenon. This is due to several reasons and factors that we have explained in this study, including political, economic, financial and even legal reasons. Accordingly, the manifestations of corruption varied, so we have explained them according to the field of corruption such as political corruption, financial and administrative corruption… then according to its crimes forms, both the traditional corruption crimes stipulated by the penal codes of the Maghreb countries, and the new corruption crimes created under anti-corruption laws, in line with the provisions of the United Nations Convention against Corruption. All these formes and manifestations of corruption have had a severe negative effects on the economies of the Maghreb countries and on their political, financial and social systems such as Algeria, Tunisia and Morocco, which we have set as examples of this study, trying to highlight the main causes of corruption and its manifestations that must be eliminated or mitigated, at least, rather than focusing efforts on fighting corruption after it happened, all to avoid the great damage it’s causing to the Maghreb countries.
