دور القانون الدولي لحقوق الإنسان في تكريس الحق في التعليم العالي

Résumé: ملخص: كرّس القانون الدولي لحقوق الإنسان الحق في التعليم العالي في العديد من الصكوك الدولية العالمية منها والإقليمية، وأبرز أهمية تكريس الحق في التعليم العالي بالنسبة للفرد والمجتمع، ولذلك فإن طبيعة التزامات الدول الأطراف تجاه الحق في التعليم العالي هي التزامات فورية وتدريجية في الوقت نفسه. ومن ثمة، فإن انتهاك الدول لهذا الحق أو إهماله يعد تخليا للدولة عن التزاماتها التي التزمت بها بمحض إرادتها، ما يعطي الحق لضحايا الحق في التعليم للدفاع عن حقوقهم بالوسائل المقررة قانونا، وذلك على المستوى الداخلي أولا، ثم على المستوى الدولي في حالة عدم استجابة السلطات الوطنية. Abstract International human rights law has devoted the right to higher education in many international and regional instruments, and has highlighted the importance of the right to higher education for the individual and society. Therefore, the nature of States parties obligation towards the right to higher education is immediate and gradual at the same time, States’ violation or neglect of this right is tantamount to relinquishing the State’s obligation to its own will, gives the victims of the right to education the right to defend their rights by means of the law, at the local level first, then at the international one in case of the law, at the local level first, then at the international one in case of non-respond of National authorities.
