Est-il Temps Pour Une Cour Internationale Des Conflits : Un Œil Sur Les Différends Liés Au Droit De La Mer ?

Résumé: Le système judiciaire international a connu depuis une vingtaine d’années une multiplication des juridictions internationales, spécialement en Droit de la mer, sujet de notre étude. Le Droit de la mer a vu naitre un Tribunal international du Droit de la mer et des Tribunaux d’arbitrage (général et spécial), sans pour autant éliminer les juridictions internationales traditionnelles telles que la Cour internationale de justice et la Cour permanente d’arbitrage. La multiplication des juridictions internationales en Droit de la mer est due à diverses raisons, en l’occurrence la volonté des États, la nature des différends liés au Droit de la mer et la diversité de ses sources, spécialement les sources conventionnelles. Cette multiplication offre, d’un côté, un choix immense de moyens de résolution des différends et pose, d’un autre côté un problème de conflit de compétence et de jugements contradictoires, problème auquel le Droit international en général et le Droit de la mer, plus spécialement, doivent faire face et d’où se pose la question de la nécessité d’une Cour internationale des conflits./////////////////////////////////////////////////////////////////////////////////////The international legal system has known, for about twenty years, a multiplication of the international jurisdictions, especially in the Law of the sea that is the subject of our study. The Law of the sea witnessed a birth of an International tribunal for that end, in addition to Arbitral Tribunals (general and special arbitration), without eliminating the traditional international jurisdictions such as the International Court of Justice and the Permanent Court of Arbitration. The multiplication of the international jurisdictions in the Law of the sea is due to varied reasons, such as the will of the countries, the nature of disputes related to the Law of the sea and the diversity of its sources, especially the conventional sources. This multiplication offers not only an immense choice of means of resolution, but, also, poses a problem of conflict of competence and contradictory judgments, a problem that International Law, in general, and the Law of the sea, in particular, must face. The question of the need for an International Court of the Conflicts arises then.//////////////////////////////////////////////////////////////////////////////////////////////////////////عرف التنظيم القضائي الدولي منذ حوالي عشرين سنة تعددا في المحاكم الدولية خاصة في: مجال قانون البحار؛ موضوع دراستنا، إذ شهد القانون الدولي للبحار؛ ميلاد المحكمة الدولية لقانون البحار، ومحاكم التحكيم (العام و/الخاص)، إلى جانب المحاكم التقليدية كمحكمة العدل الدولية، والمحكمة الدائمة للتحكيم. إن تعدد المحاكم الدولية في مجال قانون البحار ناتج عن أسباب عدة منها: رغبة الدول في إنشاء محاكم جديدة، طبيعة منازعات قانون البحار وتعدد مصادره-خاصة-الاتفاقية منها، وإن هذا التعدد -وإن كان من جهة-يمنح خيارا واسعا لوسائل التسوية إلا أنه -من جانب ثان-يطرح مسألة تنازع الاختصاص، وتناقض الأحكام بين هذه المحاكم، وهي ظاهرة يتعين على القانون الدولي عموما، والقانون الدولي للبحار-خصوصا-مواجهتها، ومن ثم تطرح مسألة مدى الحاجة لمحكمة تنازع دولية.
