المساءلة الثانوية الناشئة عن الأخطاء الواقعة أثناء ممارسة الألعاب الرياضية على ضوء التشريع الجزائري

Résumé: مع تزايد حدة العنف الرياضي في الآونة الآخرة كان لابد من إيجاد آليات قانونية تعمل على مواجهة هذه الأخطار مع الأخذ بعين الاعتبار حدود مشروعية ممارسة اللعبة وما يمكن أن يرتب عليها من مسؤولية قانونية عن الأخطاء التي قد تقع أثناء ممارسة الألعاب الرياضية و إن المسؤولية بجميع أنواعها شغلت الفقه واستوقفت القضاء فأكثر من الاجتهاد فيها ولجأ إليها المتضرر للحصول على التعويض فتعددت الدعاوى المستندة إليه،ومن هذا المنطلق سنتناول موضوع المسؤولية القانونية التي تنشأ عن الأخطاء التي تقع أثناء ممارسة الألعاب الرياضية على ضوء التشريع الجزائري. Whith the increase in sports violencent in recent times,it was necessary to find legal mechanisms that work to confront these errors, taking into account the limits of the legality of playing the game and the legal responsibility that can result from it for mistakes that occur during the practice of sports . The judiciary is more than diligent in it , and the victim has resorted to it to obtain compensation ,so the lawsuits assigned to him have multiplied ,and from this point of view we will address the issue of legal responsibility that arises from errors that occur during the practice of sports in the light of Algerian legislation.
