الاستثمار الفلاحي عن طريق استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة في الجزائر: دراسة حالة ولاية تبسة

Résumé: الملخص : تهدف هذه الدراسة للتعرف على أهم القوانين التي اعتمدت عليها الجزائر لتنظيم مسألة استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة والموجهة للاستثمار الفلاحي منذ الاستقلال إلى غاية يومنا هذا، مع تشخيص وضعية العقار الفلاحي في ولاية تبسة من خلال تحليل مجموعة من البيانات والإحصائيات المتعلقة بالأراضي الفلاحية الممنوحة في إطار قانون الامتياز الفلاحي رقم 10-03، وتوصلت الدراسة إلى أن العقار الفلاحي في تبسة يواجه العديد من المشاكل أبرزها الاستغلال الغير القانوني للأراضي الفلاحية، بالإضافة إلى المشاكل القانونية الكثيرة حول ملكية هذه الأراضي من طرف الفلاحين. Abstract : The present study aims to shed light on the most significant Algerian laws which were used to regulate the issue of the exploitation of agricultural lands belonging to the private property of the state and directed to agricultural investment from independence until the present day. The paper seeks also to diagnose the situation of agricultural property in the state of Tebessa by analyzing a set of data and statistics related to agricultural lands granted within the framework of the Agricultural Concession Law No. 10-03. The findings of the study revealed that agricultural property in Tebessa faces many issues, the most prominently is the illegal exploitation of agricultural lands, in addition to the numerous legal entanglements regarding the ownership of these lands by farmers.
