عقد الايجار التجاري في التشريع الجزائري

Résumé: ظهر القانون التجاري وتكور مع التطورات التي شهدها العالم خاصة في المحال الاقتصادي وهذا ما جعل من الدولة الجزائرية في حاجة ملحة لتعديل قانونها ليتماشى مع التطور الاقتصادي والتجاري بعد الانفتاح على اقتصاد السوق الذي طرأ مؤخرا، ومن أهم العقود التي نظمها هذا القانون هو عقد الإيجار التجاري والذي شهد مرحلتين من خلال التعديل الذي لحق بالقانون التجاري وأدى هذا التعديل لتغيير إجراءات وقواعد في التجارات لتتماشى مع ما يحصل في العالم وباعتبار أن التعديلات التي مست عقد الإيجار التجاري في العديد من الجوانب والتي غيرت مجرى الحماية القانونية الممنوحة للمؤجر أو المستأجر، فكان لابد من إلقاء الضوء على هذه التغييرات ومدى تأثيرها و انعكاسها على الحياة التجارية.The commercial law appeared and formed with the developments that faced the world in particular in the economic field. This leads the Algerian government in an urgent need to amend its law to conform to the economic and commercial development after opening up to the market economy that occurred recently. A commercial lease contract is one of the important contracts that regulated by this law. It faced two faces during the amendment to the commercial law, and this amendment led to a change in the procedures and rules in trade in order to conform to what is happening in the world. Considering that the amendments that affected the commercial lease contract in many aspects and that changed the process of legal protection granted to the leaser or lease. Hence, it was necessary to shed light on these changes and the extent of its impact and reflection on commercial life.
