أحكام تجديد ورفض تجديد عقد الإيجار التجاري في التشريع الجزائري

Résumé: الملخص: يعتبر عقد الإيجار التجاري من أهم صور التعاملات العقدية في القانون الجزائري لما يلعبه من دور في تدوير عجلة التنمية وإنعاش الاقتصاد في الدولة، وهو الأمر الذي جعله محل اهتمام المشرع الذي كان يعمل دائما على ضبطه بأحكام قانونية من شأنها ضمان حقوق وواجبات كل من المؤجر والمستأجر بما يتوافق والأحكام الدولية التي أصبحت تفرض ضرورة انفتاح التوجهات القانونية للدولة على المبادئ والأحكام القانونية الدولية، وهو ما فرض تعديل أحكام القانون التجاري، ما خلق تباينا في وجهات النظر الدارسة لهذا التعديل ما بين مؤيد للأحكام القانونية الجديدة المتعلقة بعقد الإيجار التجاري ومعارض لها. وسنقوم من خلال هذا المقال بتسليط الضوء على أحكام تجديد عقد الايجار في ظل القانون 05-02 المتضمن تعديل القانون التجاري مع التطرق لبعض المقارنة مع الأحكام السابقة لهذا العقد قبل التعديل. Abstract : The commercial lease agreement considered like one of the most important forms of contractual dealings in Law. Because it plays a role in rotating the wheel of development and revitalizing the economy in the country. which made it the concern of the Legislator who has always worked to control it with legal provisions that guarantee the rights and duties of both the Lessor and the Tenant In accordance with international provisions that impose the need for the state's legal orientations to open up to international legal principles and provisions. Which created a difference in the viewpoints studying this amendment between those who support and oppose the new provisions related to the commercial lease. Through this research paper, we will studied the provisions for renewing the lease agreement under Law 02-05which includes the amendment of the Commercial Law.
