Résumé: الملخص " تشغيل الأجانب على ضوء قواعد القانون الدولي للعمل " إن الهدف الذي يسعى إلى تحقيقه الأجنبي بهجرته الدولية من أجل العمل، هو في الغالب السّعي و ا رء ال رزق في دولة العمل. غير أن هذا المُبتغى قد تقف في طريقه تحدّيات كثيرة، لعلّ أهمّها هو منافسة و م ا زحمة اليد العاملة الوطنية في سوق العمل، و بُعدهم عن بلًدهم، و ذلك ما يجعل فئة العمال الأجانب، من أكثر الفئات العمّالية ضعفا و أكثرها حاجة إلى رعاية مصالحهم و حماية حقوقهم بقواعد القانون الدولي للعمل، و التي صدرت في شكل معايير دولية، منها ما تجسّد في اتفاقيات دولية، و منها ما تمّ صياغته في اتفاقيات إقليمية، أرست لمبادئ و حقوق أساسية مهمة، منها ما تعلّق بالعامل الأجنبي بصفته إنسانا، و منها ما تعلّق به بوصفه عاملً. و يبقى أكبر تحدّي هو امتثال الدول-خاصة المصدِّ قة على تلك الصكوك الدولية- إلى الإلت ا زم بأحكامها، و اجتهادها في إيجاد نوع من التوازن ، تكفل به حقوق العمال الأجانب من جهة، و تضمن به عدم المساس بسيادتها الداخلية و نظامها العام من جهة أخرى . Résumé : « Emploi des étrangers selon la Loi internationale du Travail » Le but aspiré par un étranger à travers son émigration internationale aux fins de trouver un travail, est d’avoir une vie décente dans le pays ou il exerce. Néanmoins, ce but fait face à plusieurs défis, parmi lesquelles la concurrence avec la main d’oeuvre nationale sur le marché du travail, le fait d’être loin de leurs pays. Ce qui rend la catégorie des travailleurs étrangers la plus faible et la plus nécessiteuse pour protéger leurs droits à travers la loi internationale du travail, préconisée sous les formes de normes internationales, soutenues par des conventions internationales ou régionales, résultant des principes et des droits fondamentaux importants relatifs au travailleurs étrangers . Le plus grand défi demeure le respect des pays – principalement ceux ratifiant les conventions internationales- de leurs engagements à ses disposition et à trouver un équilibre, permettant de préserver les droits des travailleurs étrangers d’une part, et assurant sa souveraineté interne et son ordre public, d’une autre part. However, this goal may face many challenges, the most important of which is the competition and competition of the national workforce in the labor market, which makes the category of foreign workers, and because of their distance from their country, one of the most vulnerable workers and the most need to take care of their interests and protection their rights under the rules of international labor law, wich were issued in the form of international standards, including those embodied in the form of international conventions, including those formulated in the form of regional convention, laid down important principles and basic rights, including the foreign worker as a human being, tags as a factor. The greatest challenge remains the compliance of states –particularly those ratified by those international instruments –with their provisions and their determination to find a balance in which to guarantee the rights of foreign workers on the one hand and ensure that their internal sovereignty and public order are not affected.
