الهوية الإسلامية للأسرة الجزائرية بين قانون الأسرة والقانون الدولي

Résumé: تعتبر الأسرة الخلية الأساسية للمجتمع، والحفاظ على الهوية الإسلامية للأسرة الجزائرية هو تكريس في الوقت ذاته للقاعدة الدستورية: الإسلام دين الدولة، ولقد لعب المشرع من خلال قانون الأسرة دور هاما في ذلك، إذ أنه لا يسمح بالزواج إلا في إطار شرعي بتوفر شروط أهمها أن يكون طرفي العقد رجل وامرأة، كما أن المشرع كرس حماية للهوية الإسلامية للأسرة الجزائرية في مواضع عديدة، منها اعتماد ضابط الدين في الحضانة وفي توزيع التركات. The family is considered the basic cell of society, and preserving the Islamic identity of the Algerian family is at the same time consecrating the constitutional rule: Islam is the religion of the state. The legislator, through the Family Code, has played an important role in this, as it does not allow marriage except within a legal framework provided that conditions are met, the most important of which is The two parties to the contract must be a man and a woman, and the legislator has enshrined the protection of the Islamic identity of the Algerian family in many places, including the adoption of a religious officer in custody and in the distribution of inheritances.
