المسؤولية الجزائية عن جرائم الإعلام في التشريع الجزائري

Résumé: تهدف هذه الدراسة إلى تحديد مفهوم الجريمة الإعلامية وفقا لقانون العقوبات وقوانين الإعلام، بالإضافة إلى تحديد نطاق المسؤولية الجنائية الناجمة عن مخالفة الأحكام والضوابط المتعلقة بممارسة العمل الإعلامي في الجزائر، ومبررات قيام المسؤولية الجزائية للأشخاص المعنوية على غرار الأشخاص الطبيعيين إذا ما ارتكبت هذه الجرائم باسم المؤسسة الإعلامية أو لحسابها. وقد قيد المشرع الجزائري ممارسة العمل الإعلامي وجعل له حدود ينتهي عندها عندما تبدأ حقوق وحريات الآخرين، بحيث لا يجب أن يساء أو يتعسف في استعماله وألا يستهدف القيم التي يحرص عليها كل إنسان من الشرف والإعتبار والتي يحميها القانون عن طريق تجريم حالات تجاوز حق النقد عندما تصل إلى حد القذف أو السب، لأن إطلاق مجال حق النقد يؤدي إلى الفوضى والإضطراب في الحياة الاجتماعية. Abstract: This study aims to define the concept of media crime in accordance with the Penal Code and media laws, as well as to determine the scope of criminal liability resulting from violations of the provisions and controls relating to the practice of media work in Algeria, and the justifications for criminal liability of moral persons such as natural persons if such crimes are committed on behalf or on behalf of the media organization. The Algerian legislator restricted the practice of media work and put an end to the beginning of the rights and freedoms of others, so that they are not abused and do not target the values of interest to every human being, namely honour and consideration, which is protected by law by criminalizing abuses of the right to criticism when they reach the point of defamation, slander or humiliation, because failure to restrict the right to criticism can lead to chaos and unrest in social life.
