انضمام الدول العربية لاتفاقية " سيداو" بتحفظ و أثره على تجسيد موضوع الاتفاقية وغرضها

Résumé: ملخص: تهدف الدراسة التي بين أيدينا الى تسليط الضوء على انضمام الدول العربية للاتفاقية الدولية لمناهضة جميع أشكال التمييز ضد المرأة لعام 1979 م بتحفظ،و أثره على تجسيد موضوع الاتفاقية وغرضها المتمثل في القضاء على جميع أشكال التمييز ضد المرأة و مساواتها بالرجل في الحقوق الإنسانية في جميع مناحي الحياة،الذي رصدت له الاتفاقية أحكاماً إجرائية و موضوعية لإنفاذه عملياً في أرض الواقع دون ابطاء، وتحفظات الدول العربية المبداة على بعض أحكام اتفاقية " سيداو" استندت لعدة مبررات، منها مخالفتها لتشريعاتها الوطنية و أحكام الشريعة الإسلامية، حيث تَعتبر اللجنة المعنية بالقضاء على التمييز ضد المرأة أن هذه التحفظات لا تتوافق مع موضوع الاتفاقية وغرضها و تؤثر سلباً على تجسيد حقوق المرأة فعلياً. Abstract : The present study aims to shed light on the accession of Arab states with reservations to the 1979 International Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) and its impact on the realization of the convention's objectives and purpose. This purpose is to eliminate all forms of discrimination against women and to ensure their equality with men in human rights, for which the convention has established procedural and substantive provisions to be practically enforced without delay. The reservations made by Arab states to certain provisions of the CEDAW Convention are based on various justifications, including contradictions with their national legislation and Islamic Sharia law. The Committee on the Elimination of Discrimination Against Women considers these reservations inconsistent with the convention’s purpose and objectives, negatively affecting the actual realization of women's rights.
