Résumé: الملخص: إن فك الرابطة الزوجية قد يتم بالطلاق إذا صدر من الزوج، كما يتم بالتطليق إذا طالبت به الزوجة وحكم لها القاضي. هذا وإن كان كل من الطلاق والتطليق مشروعا شرعا وقانونا، إلا أن لهما آثار وخيمة على الأسرة والمجتمع، مما أدى بالمشرع إلى محاولة العمل على الحد منهما، فوضع وسائل تقي من وقوع الطلاق وهي الصلح والتحكيم بين الزوجين قبل أن يفترقا، كما وضع وسائل علاجية بعد الطلاق تتمثل في تعويض المطلقة بمبلغ قد يعجز الزوج عن تسديده، وكذا استئثارها بمسكن الزوجية إذا كانت حاضنة، مما قد يردع الزوج ويجعله يعدل عن الطلاق. رغم كل هذا، أضحى الطلاق منتشرا على أرض الواقع، مما يسلط الضوء على مدى فعالية نصوص قانون الأسرة في المحافظة على الرابطة الزوجية. الكلمات المفتاحية: حماية الأسرة. الطلاق. الصلح. التحكيم. Abstract: Breakdown the marital bond may be done by repudiation if it is issued by the husband, as by the divorce if the wife requests it and the judge rules for her. This is even if both divorce and repudiation are legitimate and legal project, but they have dire effects on the family and society, which led the legislator to try to work to reduce them. Divorce consists in compensating the divorced woman with an amount that the husband may be unable to pay, as well as monetizing it with the marital home if she is incubated, which may deter the husband and make him divorce. Despite all this, divorce became widespread on the ground, highlighting the effectiveness of family law provisions in maintaining marital bonds. Key words: family protection. Divorce. Reconciliation.
