سلطة مجلس الأمن في إحالة الجرائم الدولية إلى المحكمة الجنائية الدولية

Résumé: لقد تناولت هذه الدراسة حالة تحريك الدعوى أمام المحكمة الجنائية الدولية من قبل مجلس الأمن استناداً لإحكام الفقرة "ب" من المادة (13) من النظام الأساسي، إذ بموجب هذه المادة يستطيع مجلس الأمن إحالة حالة إلى المحكمة وذلك بموجب قرار يصدر منه استنادا للفصل السابع من ميثاق الأمم المتحدة. وقد استعمل مجلس الأمن سلطته في الإحالة إلى المحكمة في حالتين في النزاع في السودان وليبيا وعجز مجلس الأمن في إحالة الوضع في فلسطين وسوريا إلى المحكمة الجنائية الدولية. Abstract This study dealt with the case of proceedings before the International Criminal Court by the UN Security Council on the basis of the judgments of paragraph (b) from article 13, of Primary law. Due to this article, the Security Council can refer a case to the Court by virtue of a decision issued under the 7th Chapter of the Charter of the United Nations. The Security Council has used its authority to refer to the International Criminal Court in two cases, in the Sudan conflict, the events in Libya, and couldn't refer the situation in the case of Palestine and Syria to the International Criminal Court.
