Résumé: ملخص: يعتبر مجلس الأمن جهازا سياسيا أما المحكمة الجنائية الدولية فهي جهاز قضائي، لكنهما يسعيان إلى تحقيق هدف واحد، وهو الحفاظ على السلم والأمن الدوليين، ولذلك أقر النظام الأساسي للمحكمة الجنائية الدولية في مقدمته مبدأ استقلالية المحكمة، حفاظا على الشفافية والحياد والمساواة لتحقيق العدالة الدولية، وملاحقة مرتكبي أخطر الجرائم الدولية التي تثير قلق المجتمع الدولي بأسره ومعاقبتهم، ويتمتع مجلس الأمن بحق إحالة أي قضية يراها تدخل في اختصاص المحكمة الجنائية الدولية، وبمقتضى هذه العلاقة قد يكون لمجلس الأمن دور مساعد في تفعيل الاختصاص الموضوعي للمحكمة الجنائية الدولية فيصبح جهازا مساعدا ومكملا لها، كما يمكن أن يلعب دورا عكسيا. الكلمات المفتاحية: الإحالة؛ مجلس الأمن؛ المحكمة الجنائية؛ السلم ؛ الأمن. Abstract: The Security Council is a political organ and the International Criminal Court is a judicial organ, but they both seek to achieve one goal, which is to maintain international peace and security. Therefore, the Statute of the International Criminal Court approved, in its preamble, the principle of the independence of the Court, in order to preserve transparency, impartiality and equality to achieve international justice, and to prosecute and punish the perpetrators of the most serious international crimes of concern to the international community as a whole, The Security Council has the right to refer any case it deems to fall within the jurisdiction of the International Criminal Court, Under this relationship, the Security Council may have an auxiliary role in activating the substantive jurisdiction of the International Criminal Court, so it becomes an auxiliary and complementary organ, and it can play a reverse role. key words: Referral; Security Council; Criminal Court ; Peace; Security.
