ضمانات تطبيق مبدأ تدرج التشريع في القانون الجزائري والفقه الإسلامي

Résumé: يعد مبدأ تدرج التشريع أحد المقومات الأساسية للدولة الدستورية، والذي يتلخص معناه في وجود تدرج هرمي بين القواعد القانونية التي يتكون منها النظام القانوني في الدولة، وهذا ما يجعل بعضها أسمى مرتبة من بعض، مع وجوب خضوع القاعدة الأدنى للقاعدة الأسمى. ويتناول هذا البحث الضمانات الواجب مراعاتها لتطبيق هذا المبدأ والمتمثلة أساساً في وجوب إقامة نوع من الرقابة على صحة التشريع، وذلك من خلال تنظيم آليات الرقابة على دستورية القوانين لضمان التزامها بأحكام الدستور، وكذا الرقابة على مشروعية اللوائح لضمان التزامها بأحكام الدستور والقوانين. The principle of hierarchy of legislation is one of the basic components of the constitutional state, which is summarized in the existence of a hierarchy between the legal rules that make up the legal system in the state, This makes some of them superior to others, with the lower rule having to be subordinate to the supreme rule. This research deals with the guarantees to be observed for the application of This principle, which is mainly represented in the necessity of establishing some kind of control over the validity of legislation, This is done by organizing mechanisms to monitor the constitutionality of laws to ensure their compliance with the provisions of the Constitution, as well as monitoring the legality of regulations to ensure their compliance with the provisions of the Constitution and laws.
