تأثر كل من الإرادة المنفردة و العقد في القانون المدني بالشريعة الإسلامية Both The Unilateral Will And The Contract In Civil Law Were Affected By Islamic Law

Résumé: إنَّ من بين جميع التَّخَصُّصات الأقرب إلى القانون المدني نجد الشَّريعة الإسلامية التي إعتبرها كأحد مصادرها فَنَظَّمَ نُصوصًا لها علاقة بها ، ولو تمَحَّصنا في هذا الفرع من القانون لوجدنا بعض نُصوصه متأثِّرة أو مُستنبطة من الأحكام الفقهية لعلوم الشريعة الإسلامية ، خاصَّةً منها المسائل التي تتأثَّر بظروف الزَّمان والمكان وبكل ماتدعوا إليه المصلحة الجالبة للخير والنفع للفرد والمجتمع ، مِمَّا اهتدى المشرع بأن يجعلها كأحد مصادر هذا الفرع ، ليصل القاضي بها إلى العدالة التي طالما كانت مَطلبًا لكل الشُّعوب. وانطلاقا من هذا سنحاول في هذا البحث تحديد العلاقة فيما بين كل من القانون المدني الجزائري وعلوم الشريعة الإسلامية من خلال إظهار تأثر كل من العقد والإرادة المنفردة بالشريعة الإسلامية باعتبارهما كمصدرين إراديين من مصادر الإلتزام في القانون المدني. Among all these disciplines that are closest to civil law, we find Islamic law, as he considered it as one of its sources, so he organized texts related to it. The time and place and everything they call for is the interest that brings goodness and benefit to the individual and society, which guided the legislator by making it as one of the sources of this branch, bringing the judge to justice, which has always been a demand for all peoples Based on all of the foregoing, we will try in this research to determine the relationship between both civil and Algerian law and the sciences of Islamic law by showing the impact of both the contract and the unilateral will on Islamic law as they are voluntary sources of commitment in civil law.
