حماية الأقليات في الشريعة الإسلامية والاتفاقيات الدولية - حرية المعتقد نموذجا -
Résumé: هذا البحث بعنوان: "حماية الأقليات في الشريعة الإسلامية والاتفاقيات الدولية –حرية المعتقد نموذجا-"، درسنا فيه الإشكالية الآتية: ما مدى حماية الأقليات وحقوقها في الشريعة الإسلامية والاتفاقيات الدولية خاصة من ناحية حرية المعتقد؟ في أربعة مباحث: المبحث الأول: الأقليات وحرية المعتقد في الشريعة الإسلامية والاتفاقيات الدولية، والمبحث الثاني: ضمانات حرية المعتقد وقيودها، المبحث الثالث: آليات حماية حرية المعتقد، المبحث الرابع: نماذج عن انتهاكات حرية المعتقد، وأخيرا ختمنا بحثنا بنتائج أهمها: أن الإسلام سبق الاتفاقيات الدولية في تقرير حقوق الأقليات، وتكريس مبدأ المساواة بين المسلمين وغير المسلمين، وعدة توصيات أهمها: الزامية تطبيق ما أقرته الشريعة الإسلامية من أحكام في الاتفاقيات الدولية والمجتمع الدولي؛ لأن أحكامها صالحة لكل زمان ومكان ولقد جاءت للناس كافة دون تمييز بسبب لون أو جنس أو دين.This research entitled: “Protection of Minorities in Islamic Law and International Agreements - Freedom of Belief as a Model-”, in which we studied the following problem: To what extent are minorities protected and their rights in Islamic law and international agreements, especially in terms of freedom of belief? In four sections: the first topic: minorities and freedom of belief in Islamic law and international agreements, the second topic: guarantees of freedom of belief and its restrictions, the third topic: mechanisms for protecting freedom of belief, the fourth topic: examples of violations of freedom of belief, and finally we concluded our research with the most important results that Islam preceded International conventions in determining the rights of minorities, enshrining the principle of equality between Muslims and non-Muslims, and several recommendations, the most important It is mandatory to implement the provisions approved by Islamic law in international agreements and the international community; Because its rulings are valid for all times and places and they came to all people without .discrimination due to color, gender or religion .
