نظرية أعمال السيادة في الجزائر: قناعة أم تقليد؟

Résumé: تعالج هذه الدراسة اعمال السيادة في الجزائر ومدى قناعة المشرع الجزائري بها، إذ تهدف هذه الدراسة معالجة موضوع أعمال السيادة من زوايا مختلفة سواء من الناحية التاريخية أو في البحث عن مفهوم أعمال السيادة، الأمر الذي من شأنه توضيح الأساس القانوني لها في الجزائر، ومدى مسايرة القضاء في الجزائر لها. وفي إطار دراستنا لهذا الموضوع عبر محطات قانونية أو اجتهادات قضائية فإذا كان يظهر مبدئيا توسع المشرع والقاضي الإداري في الجزائر بالإستناد إلى نظرية أعمال السيادة بإخراج بعض أعمال الإدارة من رقابة القضاء الإداري، إلا أن هذا الأمر يعد نسبيا فرضته عدة مبررات لتوظيفها بصفة إستثنائية. This study deals with the acts of sovereignty in Algeria and the extent of the Algerian legislator’s conviction in it. This study aims to address the issue of sovereignty acts from a historical point of view or to search for concept of sovereignty acts, which helps clarify the legal basis for it in Algeria and the areas of its application by the judiciary in Algeria. In the context of our study of this topic in law or jurisprudence, if it appears at the beginning, the legislator and the administrative judge in Algeria expanded to rely on the theory of sovereignty acts by removing some of the administration's actions from the supervision of the administrative judiciary, but this matter is relatively due to his justifications in order to apply them exceptionally.
