أعمال السيادة والرقابة القضائية

Résumé: يمكن أن نخلص موضوعنا إلى أن الرقابة القضائية على أعمال السيادة تنوع وتتغير بحسب تنوع طائفة هذه الأعمال ذاتها، فمنها المرتبطة بالعلاقات الدولية و العمل الدبلوماسي، ومنها ما يرتبط بعلاقة الحكومة بالسلطات الأخرى، وهما النوعين البارزين في طائفة أعمال السيادة وحفل خصب لقرارات السلطة التنفيذية التي تفلت من الرقابة القضائية. لكن بفسح المجال أمام الحق في التقاضي كمبدأ عام، واستنادا إلى ذلك يمكن قيام مسؤولية مترتبة عن العمل الحكومي لها أسسها وأركانها وهي إما أن تكون مسؤولية على أساس الخطأ الذي ينسب إلى الحكومة أو السلطة التنفيذية مع إمكانية التعويض عنه، ومن جهة أخرى فقد ابتدع الفضاء الفرنسي فكرة المسؤولية دون خطأ و التي لا ينظر بشأنها في موضوع الخطأ إلما في التعويض الناتج عنه، وقد ميز القضاء الفرنسي بين المسؤولية عن أعمال الحرب التي تكون داخل الإقليم أو خارجه وما يرتبه ذلك من أثر في التعويض عن الأعمال الحكومية. الكلمات المفتاحية: أعمال السيادة، الرقابة، القضاء. Abstract: We can conclude our topic that judicial control over the acts of sovereignty varied and changes according to the diversity of the spectrum of these same acts, some of them are related to international relations and diplomatic work, and some are related to the government’s relationship with other authorities, and they are the two prominent types in the range of acts of sovereignty and a fertile ceremony for the decisions of the executive authority that escape of judicial oversight. But by giving way to the right to litigation as a general principle, and based on that, it is possible to establish a responsibility resulting from government work that has its foundations and pillars, which is either responsibility based on the error attributed to the government or the executive authority with the possibility of compensation for it, and on the other hand it created the French space The idea of responsibility without fault, which does not consider the issue of error except in the compensation resulting from it, and the French judiciary distinguished between responsibility for acts of war that take place inside or outside the region and the impact that this has on compensation for government actions.
