معوقات إعداد عقود الامتياز الفلاحي المتعلقة بتحويل حق الانتفاع الدائم إلى حق الامتياز المؤقت

Résumé: صدر قانون الامتياز الفلاحي رقم 10/03 في 15/08/2010، ليحدد شروط وكيفيات استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، ورغم مرور عدة سنوات إلا أن عملية تحويل حق الانتفاع الدائم إلى عقد امتياز وفقا لقانون رقم 10/03، لم تنته بعد إلى غاية يومنا هذا رغم مرور سنوات عديدة على بدايتها، وذلك لمعوقات عديدة استوجبت منا دراستها في هذه الورقة البحثية. Abstract: Concession Law No. 10/03 was issued on 15/08/2010, It's the law applied to agricultural investments that arose under the old Permanent Usufruct Law No. 87/19. Under the new law, the permanent usufruct right was converted into a temporary concession for a period of 40 years, subject to renewal, and concession contracts were prepared for owners of agricultural investments. Despite the passage of several years, the process of preparing agricultural concession contracts in accordance with Law No. 10/03 has not been completed to this day, despite the passage of many years since the beginning of the process, for many reasons that required us to study them, whether these reasons are at the level of the National Agricultural Office, or at the level of state property and the real estate governorate, or at the level of the Land Survey Directorate, or at the level of the agricultural investor himself.
