عن إشكالية تنظيم عقد البث الفضائي عبر الأقمار الصناعية

Résumé: اعتبارا للتطور الهائل في مجال التكنولوجيات الحديثة للإعلام والإتصال خاصة في مجال ظهور الأقمار الصناعية،فقد أضحت خدمات البث الفضائي أهم وسيلة لإرضاء حاجة الفرد اللاّمتناهية للمعرفة وإيصالها المبثوثات السمعية والمرئية إلى الجمهور،ونظرا لأهمية عقد البث الفضائي في التواصل بين مختلف الشعوب من جهة وللإشكالات القانونية التي يثيرها خاصة ما تعلق منها بتحديد مفهومه وخصوصية طبيعته القانونية وهو ما تسعى الدراسة لتسليط الضوء عليه في ظل النصوص القانونية السارية في تنظيم أحكامه لا سيما القانون 18-04 المتعلق بالبريد والإتصالات الإلكترونية وكذا المرسوم التنفيذي 16-222 المتعلق بالقواعد المفروضة على خدمة للبث التلفزيوني أو الإذاعي . الكلمات المفتاحية: عقد البث،الأقمار الصناعية،تكنولوجيا الإعلام والإتصال. Abstract : Given the tremendous development in the field of modern information and communication technologies, especially in the field of the emergence of satellites, satellite broadcasting services have become the most important means to satisfy the individual's endless need for knowledge and to deliver audio and visual broadcasts to the public, and given the importance of the contract of satellite broadcasting in communication between different peoples on the one hand and the legal problems that It is particularly raised by what is related to it by defining its concept and the specificity of its legal nature, which the study seeks to shed light on in light of the legal texts in force in regulating its provisions, especially Law 18-04 related to mail and electronic communications, as well as Executive Decree 16-222 related to the rules imposed on a television or radio broadcasting service .
