الجوانب الإجرائية الخاصة بشروط قبول الدعوى العقارية

Résumé: ملخص : عمدت مختلف التشريعات ومن بينها المشرع الجزائري في حماية المعاملات العقارية سواء بين المتعاملين أنفسهم أو أي شخص من الغير ،ونظرا لأهمية العقار في تحقيق التنمية الاجتماعية والاقتصادية فان المنازعات حوله تكثر وتتنوع خاصة وان كانت النصوص القانونية التي تحكمه متناقضة في كثير من الحالات،ولهذا المشرع الجزائري اعتمد في حمايته للمعاملات العقارية باللجوء إلى الدعوى القضائية باعتبارها وسيلة ناجعة التي خولها قانون لصاحب الحق الالتجاء إلى القضاء لحماية حقه، و قد اشترط القانون في رافع الدعوى أن تتحقق فيه شروط قانونية منصوص عليها في قانون الاجرءات المدنية والإدارية،شروط متعلقة بأطراف الدعوى، وشروط شكلية، و شرط إشهار العريضة الدعوى العقارية والتي يكون موضوعها التصرف في العقار أو الحقوق العينية العقارية ،اعتمدت في هذه الدراسة على المنهج التحليلي للنصوص القانونية والتنظيمية. الكلمات المفتاحية : الجانب، الإجرائي، شروط، الدعوى، العقارية. Abstract: Several legislation, including Algerian legislature, adopted protection of the real estate transactions, whether between dealers themselves or any person from others. Since the real estate is importantto achieve social and economic development, the disputes arising in its regardare numerous and various. Particularly, if the legal provisionsit is subject to are contradictory in many cases. Therefore,in protection of real estate transactions, Algerian legislaturedependedon legal procedures recourse, which is considered, as per some views, to be the effective means authorized by law the right holder to resort to the court for protecting his\ her right. The law stipulates that the lawsuit shall be filed on certain legal conditions, which are stipulated in the law of civil and administrative procedures represented in themeritsand form conditions and registrationcondition of real estate lawsuit petition whose subject matter is disposal of real estate or its in-kind rights.
